Overtime
Employers cannot unilaterally pay out banked overtime
The Provincial Collective Agreement is very clear that Employers cannot pay out overtime without an Employee’s agreement, EXCEPT at the end of the year, March 31.
Nurses CAN carry over banked overtime into the next year, after March 31, but ONLY if they request a carry over in writing and their Employer agrees. The Employer must have a sound reason if they refuse, and cannot deny it unreasonably.
Article 8 Overtime
(c) Overtime may be accumulated and taken in time off at a mutually acceptable time at the applicable premium rate. Time off not taken by March 31 in any given year shall be paid out unless otherwise mutually agreed. Such request to carry over lieu time shall e submitted by the Employee in writing prior to March 31, and shall not be unreasonably denied.
