Permanent night and evening must be at the Employee’s request
Employers may post a position with a note that it is currently a permanent nights or evenings schedule. However a successful applicant would NOT be required to take that permanent shift schedule.
Permanent night or evening shifts are possible under our collective agreements only at the request of the Employee. An applicant on a posting that has a permanent nights or evening schedule could choose NOT to work that schedule after being hired. They may be required to work it for the first 12 weeks until a new rotation can be drawn up.
Shift schedules or “lines” are NOT part of the definition of a position.
Employees applying for a position should also note that even if a shift schedule is advertised with a position, the Employer may change it later. The hours per shift and shifts per shift cycle are fixed with the job, but the schedule is not. The Employer may advertise the shift pattern with a position “for informational purposes only”. (Article 14.01 (d)).
