May 30, Letter from counsel for Health Sciences Association of Alberta regarding the appropriate forum for hearing constitutional aspects of UNA’s application for determination

The law firm representing the Health Sciences Association of Alberta has submitted a response to the question of whether the Alberta Labour Relations Board is the most appropriate forum to determine the constitutional issue put forward in United Nurses of Alberta’s Nurse Practitioner application.

HSAA’s letter indicates that union will proceed in whatever forum the Board and other parties determine to be appropriate. However, HSAA argues the ALRB’s decision will only affect Nurse Practitioners working for Alberta Health Services and not Nurse Practitioners working for other Alberta employers.

On April 5, 2018, lawyers acting for UNA filed an application with the Alberta Labour relations Board seeking a determination that the union can represent Nurse Practitioners.

UNA’s application argues that portions of the Alberta Labour Code preventing Nurse Practitioners from being represented by a union violate the right to freedom of association guaranteed in the Canadian Charter of Rights and
