June 1, Letter from counsel for UNA in response to Alberta Health Services’ position on the appropriate forum for hearing constitutional aspects of UNA’s application for determination

The law firm representing United Nurses of Alberta in its application for determination that the union can represent Nurse Practitioners employed by Alberta Health Services has filed a letter in response to concerns expressed by AHS about the appropriateness of the Alberta Labour Relations Board as the forum for the constitutional aspects of this matter.

UNA’s position is that the ALRB is the only appropriate forum for this matter.

On April 5, 2018, lawyers acting for UNA filed an application with the Alberta Labour relations Board seeking a determination that the union can represent Nurse Practitioners.

UNA’s application argues that portions of the Alberta Labour Code preventing Nurse Practitioners from being represented by a union violate the right to freedom of association guaranteed in the Canadian Charter of Rights and
